Please read these Terms and Conditions carefully before using the PayRise mobile application (the "App"), operated by PayRise ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using PayRise, you confirm that you are at least 18 years of age, you have read and understood these Terms, and you agree to be legally bound by them. If you do not agree, do not use the App.
2. Description of Service
PayRise is a personal finance tracking application that allows users to:
- Record and monitor income from multiple sources (employment, investments, real estate, freelance)
- Calculate a composite daily income score
- Set and track income goals
- Receive personalized income-growth suggestions
- Track the progress of a gamified mascot (Squeaky) tied to income milestones
PayRise is an informational tool only. It does not provide financial advice, investment recommendations, or tax guidance.
3. User Accounts
To use PayRise, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized access or use of your account. We reserve the right to terminate accounts that violate these Terms.
4. Accuracy of Information
You are solely responsible for the accuracy of the income data you enter into PayRise. The App's calculations (daily scores, projections, suggestions) are based entirely on the data you provide and are for informational purposes only. They do not constitute financial, tax, or investment advice.
5. Investment Data
For investment sources, PayRise retrieves publicly available market price data from third-party providers. This data may be delayed, inaccurate, or unavailable. Price-based income estimates reflect market fluctuations and past performance does not guarantee future results. PayRise is not a regulated financial services provider.
6. Intellectual Property
All content in the App — including the PayRise name, logo, Squeaky mascot, interface design, text, and code — is the exclusive property of PayRise and is protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the App without prior written permission.
7. Prohibited Uses
- Using the App for any unlawful purpose
- Attempting to gain unauthorized access to our systems
- Reverse-engineering, decompiling, or disassembling any part of the App
- Using automated tools to scrape or extract data from the App
- Impersonating any person or entity
- Transmitting any malware, viruses, or harmful code
8. Limitation of Liability
To the fullest extent permitted by law, PayRise and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable EU consumer law.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy, completeness, or reliability of any content within the App.
10. Termination
We reserve the right to suspend or terminate your access to the App for any material violation of these Terms. Where permitted by law, we may also terminate or suspend access for other reasons, provided we give you at least 30 days' prior notice via in-app notification or email, except where immediate action is required to protect the security or integrity of the App or its users.
11. Business Transfers
In the event of a merger, acquisition, reorganisation, or sale of all or substantially all of our assets, your data and rights under these Terms may be transferred to the acquiring entity. We will notify you via in-app notification or email before such a transfer takes effect. The acquiring entity will be required to honour these Terms or provide you with equivalent protections. If you do not accept the new terms, you may delete your account before the transfer takes effect.
12. Changes to Terms
We may update these Terms at any time. For material changes, we will provide at least 30 days' prior notice via in-app notification or email and will request your explicit acceptance before the new Terms take effect. Continued use of the App after that period constitutes acceptance only of non-material changes.
13. Alternative Dispute Resolution (ADR)
If you are a consumer resident in the European Union, you have the right to submit a complaint to an alternative dispute resolution (ADR) body before resorting to the courts. Disputes may also be submitted via the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. Our contact email for ODR purposes is the same as listed in section 14 below.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Portugal. As a consumer in the EU, you also benefit from any mandatory protective provisions of the law of the country in which you reside. Any disputes not resolved via ADR shall be subject to the jurisdiction of the courts of Portugal, without prejudice to your rights as a consumer under applicable EU law.
